General terms and conditions


Dear buyers!

The company Zavas d.o.o. offers online shopping of personal protective equipment in the online shop Zavas. We enable you to shop for protective work clothes, safety gloves, safety shoes, respiratory protection, hearing protection, eye protection, head protection, safety equipment for working at heights, ladders, scaffolds, storage and transport boxes and much more. We are distinguished by our good prices and fast delivery time and the simplest shopping 24 hours per day. The use of the online shop Zavas is free of charge.

The company Zavas d.o.o. operates the online shop Zavas and represents a provider of e-commerce (hereinafter referred to as a »provider«). Upon registration in the online shop Zavas, the visitor will receive a username, which is the same as his or her email address, and a password. The username and password explicitly specify the user and associate him or her with the entered information. Upon registration, the visitor becomes a user and obtains the right to purchase. The user’s password is known only to the user and is private. We request that the user uses the username and password only by himself or herself or that this username and password are used by a person, authorized to represent the user.

General terms and conditions of the online shop Zavas are set in accordance with Consumer Protection Act (ZVPot-UPB2), on the basis of the recommendations provided by CCIS (Chamber of Commerce and Industry of Slovenia) and international codes of e-commerce. General terms and conditions define the operation of the online shop Zavas, user’s rights and business relationship between the provider and the user.

The company Zavas d.o.o., as the provider and the seller, and the user as the buyer, regulate mutual obligations regarding the online purchasing in the online shop Zavas with the following general terms and conditions.


REGISTRATION AND VERIFICATION PROCESS

Upon registration, the visitor of the online shop Zavas enters his or her email address and chooses one of the following options: the user can be a natural person (consumer) or a legal person (any type of organization with a tax ID number).

If the email address does not yet exist in the database of business partners of the company Zavas, a link will be sent to the visitor’s email address. By clicking on the link in the email, the visitor activates further registration process, which will redirect him or her back to the registration application in the online shop Zavas.

During the further process, the visitor enters personal information, which can be later on changed or edited under the tab Profile.

Provided that the visitor has chosen a legal person as a type of a user, the system will ask him or her to only enter the company’s tax ID number and registration number. The system will then check the information in the public database of legal persons and fill out the registration form automatically. The user can enter additional information or change them and continue the registration process by confirming these information.

If at the beginning of the registration, the visitor enters an email address which already exists in the database of business partners of the company Zavas, the system will inform the visitor that the user with this email address already exists. In such a case the user can use the application »I forgot my password« and, by entering an email address, gain a new username and password which will be sent to the entered email address.

When a new user wants to register (email address does not yet exist in the database of business partners of the company Zavas), with a tax ID number or registration number of a company which is already registered in the database of business partners of the company Zavas and does business with the company Zavas under specific conditions, the verification process will be started in order to ensure safe online purchasing of legal persons.
The visitor can finish the registration process and gain a username and password, which will enable him or her to order and purchase under the general terms and conditions until the end of verification process. During the registration process the user will be notified by email about this process.
The verification claim of the newly registered user will be sent to the head office of the company on whose behalf a new user has registered as a legal person. When the company Zavas receives a confirmed verification from the company on whose behalf  the user has registered, the conditions for the user will be changed and he or she can order and purchase under specific conditions, which apply for this company.

PRICES

The prices are quoted as:
Regular prices – are the prices that are valid in the retail-advising center Zavas, BTC Ljubljana, lower floor of the hall A (hereinafter referred to as a retail-advising center Zavas), which in most cases represent the recommended selling prices of the manufacturer or importer or prices set by the provider. They apply for buyers who want to make a purchase in a retail-advising center Zavas and for buyers who order the goods over the phone or email.
Online prices – are the prices that are valid for registered users of the online shop Zavas, when making a purchase in the online shop Zavas in accordance with the sales and delivery conditions of the online shop Zavas and buyers in a retail-advising center Zavas, who use a coupon (coupon can be found on the printed PDF offer of the product in an online shop Zavas, if the coupon is available for a specific product).
Current special prices – prices, valid for the purchase made in a specific period or from a specific date, which is clearly visible from the offer on the web site or other marketing and information media.
Prices of the last available items – prices which are valid for purchasing the goods marked as LAST ITEMS, which include products that will be withdrawn from the regular offer due to the change of program or line.

All quoted prices exclude value added tax (VAT). The price includes VAT only where this is specifically indicated. The user of the online shop Zavas can check the prices in a default mode (without VAT) or can change them to prices including VAT with a simple click.

Prices quoted on the web site www.zavas.com can be changed without prior notice.

Price are valid at the time the order was placed and are not valid in advance. From the moment of conclusion of the purchase (order confirmation) all the prices and other conditions become fixed and are binding for the provider and the buyer. Where the shipping for legal persons is stopped between the order confirmation and shipping due to delays in payment, the provider has the right to withdraw from the order conditions.

Despite our hard effort to ensure that our information are up to date and correct as much as possible, it could occur, that the information about the price is incorrect. In such case or in a case where the price of a product changes during the order processing, the provider will enable the buyer to withdraw from the purchase and at the same time offer him or her a solution which will be satisfying for both parties.

Purchase conditions for deferred payment represent a subject of separate agreement between the buyer and the company Zavas d.o.o.

DELIVERY AND DELIVERY COSTS

Explanation of phrases:
Estimated shipping time – is a time limit within which the goods are shipped from the warehouse in Logatec and is estimated according to the current stock and average supply period of the supplier.
Our estimated shipping time is set before the provider confirms the order.
Shipping time – is the expected time limit within which the provider will ship the ordered goods that are expected to be in stock, from the warehouse. If the goods are not in stock in the warehouse at the moment of the order confirmation, the estimated shipping time, stated on the order confirmation, is valid.
The estimated shipping time and the shipping time can differ if a longer period passes between the calculation of these time limits and order confirmation or in a case of higher demand for certain products.

Ordered goods are delivered by different delivery service providers, who deliver the goods to the buyers all over Slovenia. The delivery service provider is chosen by the provider who has the right to choose a different delivery service if this will improve the efficiency of the delivery.

On delivery the buyer receives a goods return form, warranty certificate, in case if the product has an original warranty, and a reclamation form, with additional information regarding the individual process.

1. Delivery of Zarges products – ladders, scaffolds, boxes

Goods in stock are expected to be shipped the same or the next business day after the order confirmation (does not apply on week-ends and holidays), other goods are shipped within a time limit, stated on the order confirmation, usually within 7 to 21 days. If the user has ordered the goods which cannot be shipped within a promised time limit due to unforeseeable reasons, we will inform you about the new shipping time via the contact information you provided.

2. Delivery and delivery costs of products from the other product mix

Shipping time limit starts on the same business day, in cases when the deposit/payment is received until 12:00 on that business day, otherwise shipping time limit will start on the first business day after receiving the deposit/payment.
Delivery for all orders with a total amount above 150,00 EUR excluding VAT, is free. When the total amount is lower than 150,00 EUR excluding VAT, the company Zavas d.o.o. charges the delivery costs in the amount of 4,90 EUR plus VAT.

PURCHASING PROCESS IN THE ONLINE SHOP ZAVAS
User can see detailed information regarding the order status and content on the provider’s web site at all times. Under the Profile tab, the user can check the submitted orders, open pro forma invoices, invoices and unshipped goods with shipping times and other possible documentation.

Purchasing process is carried out in three steps:

1.step: Check your shopping basket
In this step the customer checks his or her shopping basket to see if it contains the product in a desired quantity. In this step the customer can delete the positions, change the quantity on individual position and enter a promotional discount code, if he or she has one. The user can save the content of the shopping basket or print it out in a pdf form.
The user can leave the shopping basket and continue with the browsing and ordering. Products and quantities already put in the shopping basket will remain unchanged.
After editing the shopping basket, the user can proceed to the second step of the purchase by clicking on the button »Continue to the buyer information«. The user can change the content of the shopping basket in every step of the purchase, until the end of the order. In every step it is possible to return to the previous step.

2.step: Purchase information
In this step the buyer chooses delivery and payment method.
The buyer can choose among the following delivery options:
a. personal pickup
b. packet delivery
The buyer can choose among the following payment methods:
a. pro forma invoice
b. credit card Eurocard/Mastercard / Visa / Diners

3. step: Order confirmation
In this step the customer reviews the content of the shopping basket, entered information and chosen delivery methods. By clicking the button “Submit order”, order will be completed and the customer agrees with the payment.

Order processing in the company Zavas
The employees of the company Zavas will start carrying out the activities necessary for the execution of the received orders as soon as the order will be correctly submitted (deposit receipt/payment receipt).

For those who want to pay for their order via pro forma invoice, the employees of the company Zavas will check the inflows to the current account of the company during regular business hours at 13.00 o’clock and 15.00 o’clock. Company’s regular business hours for clients represent every business day from Monday to Thursday from 7:30 to 16:30 and on Friday from 7:30 to 14:00.

Shipping the goods
Within the shipping time limits, the company Zavas will prepare the goods according to the order confirmation and shipped them to the chosen delivery address and notify the buyer by email. In this email, the provider will inform the buyer regarding the return policy and provide information on contact persons in case of late delivery and complaints. If specific goods are not in stock in the warehouse in Logatec at the time the order was submitted, so that the delivery will be only partial, a list of open items with a shipping times will be added to the goods and the delivery note. The user will be notified by email regarding the shipped package in case of postal delivery, shipment prepared for personal pickup in the warehouse in Logatec or shipment prepared for personal pickup in the retail-advising center Zavas. Personal pickup can be made with the order confirmation which will be received by email after the order verification and with an ID card.

Personal pickup – shopping center BTC: Buyer can pick up the ordered goods in person, in a retail-advising center Zavas, BTC Ljubljana, lower floor of the hall A, entrance 6A. Shipment will be prepared in a shop in one or two days after the shipping date, indicated on the order confirmation.
Personal pickup – Logatec:  the buyer can pick up the ordered goods in person in our warehouse in Logatec, Obrtna cona 1, 1370 Logatec. The shipment will be prepared in the warehouse the same or the next business day after the shipping date, indicated on the order confirmation.

Postal delivery: We will deliver the ordered goods to the buyer to a selected address through the delivery service. If the buyer has entered multiple addresses in his or her profile, he or she can choose one or add a completely new address for delivery. Product which are in stock at the time of the order confirmation are expected to be shipped on the same business day (in case the deposit will be received/order will be submitted on a business day until 12:00), or the next business day. The delivery service is expected to deliver the shipment the next business day.

PAYMENT AND PAYMENT CONDITIONS

Orders, invoices and open items are saved in an electronic form on the provider’s server and are accessible to the buyer at all times in the user profile on the web site Zavas (Profile).

Provider offers the following payment methods:

Payment with a pro forma invoice: After the pro forma invoice will be submitted, the buyer will receive a pro forma invoice in a PDF form by email, together with all the information needed for the payment. He or she can settle the amount of the pro forma invoice by making a transfer to the current account of the company Zavas d.o.o., number SI56 0208 5001 0620 119, which is opened at the NLB bank. Transaction can be made with a special money order or with a BN02 form in the online bank. After the company Zavas receives the transaction to the current account, the buyer will be notified by email which will include order confirmation and shipping time of the ordered products. Pro forma invoice is not binding for the buyer until the amount is settled. The buyer can cancel the order by not paying the pro forma invoice. After expiry date, the pro forma invoice becomes invalid and unbinding for the provider, even if the buyer pays the pro forma invoice after it expired.

Paying with a credit card Eurocard/Mastercard / Visa / Diners: After the order will be submitted, the buyer will be redirected to the application for secure online payment, where he or she can carry out an immediate payment of the ordered goods. The bank will make a reservation of the purchase amount which will be debited from the buyer’s account only after the goods will be ready for personal pickup or shipping from our warehouse in Logatec. In case of partial supply, the amount will also be debited partially. After the order has been submitted, the content of the order or the final order amount cannot be changed, except in special cases, set by the provider in a specific case.
Payment with deffered payment (Currency payment):
If the user has agreed with the company Zavas upon special conditions (currency payment), the user concludes the order by selecting currency payment. Until the payment is completed, the purchased good remains the property of the company Zavas d.o.o. In the event of delays in payment, the company Zavas d.o.o. has the right to charge the buyer statutory default interests, which the buyer has to settle within 8 days from the issue day. In case of delays in payment the company Zavas d.o.o. reserves the right to stop the order. Provider issues a receipt for the buyer on a durable medium, with itemized costs and instruction on how to return the items if this is necessary and possible.

RETURNING THE GOODS

Consumers
The user as a natural person can withdraw from the contract within 14 days of the date of receipt of the ordered goods, without having to state a reason for this decision. The notification is considered to be on time if the shipment is shipped within deadline. Return of the ordered goods to the company within 14 days of the date of receipt is equivalent to the notification about withdrawing from the contract. If the consumer has withdrawn from the contract, the provider will reimburse him or her for the paid amount as soon as possible, but no later than within 30 days of receiving the notification of contract cancellation.

If the consumer has already received the goods and withdraws from the contract, he or she must return the received goods to the company within thirty days of the notification from the previous paragraph. The received products and original packaging must be returned undamaged and in the same quantity, unless the product is destroyed, damaged, lost or its quantity decreased, through no fault of the consumer.

The consumer can return the goods within 30 days of the notification of the contract cancellation in two ways:
• He or she sends the goods, together with the invoice and all the belonging documentation, to the address Zavas d.o.o., Obrtna cona 7, 1370 Logatec, with the heading Returning the goods. The direct costs of returning the goods are paid by the customer.
• At his or her own expenses, the consumer can come in person to the retail-advising center Zavas, BTC Ljubljana, lower floor of the hall A , and return the purchased goods together with the belonging documentation.


Other users
If the order amount is lower than 500,00 EUR excluding VAT, the buyer has the right to return the ordered products to the provider without stating a reason. In this way the buyers are ensured to be able to return all the products which does not fulfil their expectations to the company Zavas d.o.o.

The products must be returned within 8 days of the received goods. The purchased products that the buyer wish to return have to be unused, undamaged, in an undamaged packaging, unchanged quantity, with a receipt and all the belonging documentation.
The buyer should send the products to the address: Zavas d.o.o., Obrtna cona 7, 1370 Logatec, with a heading Returning the goods.

If the products are returned in a correct way, the company Zavas d.o.o. will reimburse the buyer for all the paid products, only to the personal bank account – which you provide during the return process. We do not pay out cash! Purchase money will be returned to the personal bank account within 5 days of the receipt of the products in the warehouse.

Withdrawing from the contract is not possible for products, which were custom made according to the specific instructions of the consumer, adjustsed for consumer’s specific needs, are not suitable for return by nature (for example: individual insoles, individual earplugs, printed and embroidered products, ...).
Withdrawing from the contract is also not possible for products which do not belong to the regular product range of the provider. The buyer will be warned about such an offer.

The contract between the buyer and the seller can be found in an electronic form in the head office of the company Zavas d.o.o., Špruha 19, 1236 Trzin. The buyer can get a copy of the contract by sending a demand by email to prodaja@www.zavas.com or calling the number 01 5610 420.

RECLAMATIONS AND WARRANTY

Factual defects
The provider should deliver the goods to the consumer in accordance with the contract and shall be liable for the factual defects and legal defects in fulfilling the obligations. Defects are factual if the product does not possess the properties necessary for normal use or traffic, if the product does not possess the properties necessary for personal use for which purpose the consumer is purchasing it, and of which the provider was aware or should have been aware of, if the product lacks the properties or features which were expressly or implicitly agreed upon, or respectively prescribed, if the provider delivers a product which does not correspond to a sample or model, unless the sample or model was shown only for informative purposes.

Consumers

The consumer can exercise his or her rights by informing the provider about the defect within two months from the day, when the defect was discovered. The consumer must provide in the notification of the defect a detailed description of the defect and enable the provider to inspect the product. The consumer can inform the provider of the defective product in person, upon which the provider shall provide the consumer with an attestation, or the consumer may send the notification of defect to the retail location where the product was purchased or to the provider` s representative with whom the contract was concluded. The buyer can inform the provider about the defect in person, over email, fax or send the notification to the address Zavas d.o.o., Špruha 19, 1236 Trzin, desirable on the submitted Reclamation form, which can be found at the back of the receipt. The buyer can also find the Reclamation form in the online shop Zavas or send a demand for this form to the provider by email to prodaja@www.zavas.com or call the number 01 5610 420.

The provider shall not be responsible for factual defects, which appear after the manufacturer’s warranty has expired, after the goods were delivered. Warranty is aligned with the legislation regarding personal protective equipment and commercial customary practices and is determined by the manufacturers of the products.
The consumer who properly notified the provider of a defect has the right to demand from the provider the removal of the defect from the product or the partial refund of the amount paid for the product in proportion to the actual fault, or the exchange of the defective product with a faultless one, or the total refund of the amount paid.
If the quantity that the buyer receives differs from the one noted on the delivery note and invoice, he or she should inform the employees of the company Zavas d.o.o. in a written form, as soon as the goods are received or until the next business day.

When receiving the reclamation and if the defect is not disputable, the provider, company Zavas d.o.o, needs to grant the request of the buyer as soon as possible or at least within eight days, or in the same period reply to the buyer’s request.

Other users
For other buyers, the provisions of the act, regulating obligational relationships, are used for questions regarding factual defects.

For online settlement of consumer cross-border disputes arising from online sales or online services consumers can turn to the European platform for online dispute resolution.

 


WARRANTY
From Consumer Protection Act (ZVPot-UPB2, Official Gazette of the Republic of Slovenia, No. 98/2004)
A product, which has been issued a warrant for its faultless working, is a product whose faultless working is ensured through its maintenance or replacement of parts, This also applies for products which are bought separately and used as a component part of another product. The minister, in charge of the economy, shall pass a regulation which shall define products from the first paragraph of this article, and more specifically regulate the warranty’s obligations for individual types of goods, particularly the shortest warranty period and the period of time after the warranty’s expiration date, in which the producer is still liable to ensure maintenance, replacement parts or attachment devices.
For goods, which have been issued a warrant for its faultless working, the manufacturer or the seller has to provide the buyer upon the conclusion of a contract with a warranty certificate, instructions for installation and use and a list of authorized service centers. At this time the provider is obliged to ensure an authorised service center, except if he performs this service by itself. Authorised service center has a valid authorization from the manufacturer for servicing the products or has a contract for supplying the original replacement parts. The warranty certificate has to be understandable to the user. If the product will be sold in Republic of Slovenia, the entire warranty certificate needs to be translated into Slovenian language. The manufacturer shall be obligated to provide, free of charge, for the repair and maintenance of a product during the warranty period or its extension, and after that period for a charge, by providing this service itself or through an authorised service agent. Upon expiration of the warranty period, the manufacturer shall continue to be obliged to provide the consumer with maintenance, replacement parts and attachment devices. The buyer may also enforce the rights from the warranty on the seller.
The warranty certificate should contain at least the following information:
1. company and head office of the manufacturer,
2. information for identification of goods,
3. declaration with which the manufacturer guarantees the quality or flawless operation during the warranty period, which starts when the goods were delivered to the consumer,
4. warranty duration,
5. company and head office of the seller and date of delivery of goods to the consumer,
6. the shortest warranty period which cannot be shorter than one year, except if the products are used, for which the seller can determine a shorter warranty period,
7. period after the warranty expiration, within which the manufacturer is obliged to ensure maintenance, replacement parts and attachment devices, which needs to be at least three time longer than the warranty period.

The manufacturer shall also be bound by these legal obligations even if a warranty was not compulsory but was publicly promised (discretionary warranty).
In accordance with the warranty, the manufacturer shall pay for the costs of the material, replacement parts, labour, transfer and transport of product, which may arise in the process of repairing the defect or replacing a defective product with a new one.
The manufacturer shall ensure that authorized services are supplied with all the necessary replacement parts, in order to repair the defects or faults, and to immediately accept a product within a total period of a maximum of 45 days from the date the issuer of the warranty or authorized service received the demand for the free repair of the defect or fault on the product. If the manufacturer fails to service the product within this period, it shall be obliged to replace that product for the consumer with a new identical and faultless product free of charge. While a product, which is still under valid warranty, is being repaired, the manufacturer or authorized service shall provide the consumer with a similar product to use during that time, free of charge. In the event the manufacturer or authorized service fails to ensure the consumer the above, the consumer shall have the right to a reimbursement for the damage suffered as a result of not being able to use the product, from the moment the repair or replacement was demanded until the execution of the repair.

PROTECTION OF PERSONAL INFORMATION

Collection of personal information
By filling out the form, the buyer agrees that the company Zavas as an operator of the personal information database saves and shared all the given information and the information regarding the purchase processes in accordance with Personal data Protection Act (ZVOP-1). Personal information is the information which identifies you: your name, last name, phone number, email or home address. Besides the information that the buyer enters when filling out the application form, the following purchase information are also collected: product name, product quantity, measurement unit, product code, price per measurement unit, purchase amount, time of purchase, number of the purchase document – invoice, coupons: state/used/issued, discount gained by buying with a specific product with a store card.

The company Zavas, d.o.o. collects your information from the purchase in the online shop, purchase based on the demand sent to the company’s head office, purchase in the retail center Zavas, coupon order, e-coupons and subscription to the newsletter and other e-publications, participation in a survey, contest and similar activities. Personal information which were provided on the web site www.www.zavas.com in order to carry out the online purchasing, are used only for completeing the order and delivery, except if the user of the website separately agreed with any other form of the use of information (ordering coupons or e-coupons, subscription to the newsletter), which can be used for other purposes.

By his or her approval, the user allows the company Zavas, d.o.o., the administrator of the personal information database, to process the collected personal information for sampling, survey and statistical reasons, determining the use of the service, adjusting offer and segmentation, market research, informing the buyers about the offer, new products and special offers, sending newsletters and other marketing documents, informing the users about the services of the online shop www.zavas.com and the company Zavas, d.o.o., and connected clients and other forms of the usage of the provided information, about which the user has specially agreed upon.

Protection of personal information
We undertake that the personal information, gathered on the website or in any other way, described above, will be saved, protected and processed only by the company Zavas d.o.o. The administration of the website will use the gathered personal information in accordance with the Consumer Protection Act and European legislation (Directive EU 95/46/EC, 2002/58/EC and Agreements ETS 108, ETS 181, ETS 185, ETS 189).

By filling out the form and accepting these general conditions, the user confirms, that he or she is familiar with the right to access, transcribe, copy, supplement, correct, block and delete personal information relating to him or her, in accordance with the provisions of ZVOP-1.

Your information are protected from loss, destruction, falsification, manipulation and unauthorized access or unauthorized disclosure to a third party.

CHANGING GENERAL TERMS AND CONDITIONS

The company Zavas has the right to change the general terms and conditions at any time, if this is required by the technical, commercial reasons or is such reasons are deemed necessary by the public.

The company Zavas d.o.o should properly inform the user about changing the general terms and conditions. A proper way is considered a post on the web site www.www.zavas.com.

LIMITATIONS OF LIABILITY

The provider shall to the best of its ability strive to maintain the currency and accuracy of the information published on its website. Despite his efforts, the characteristics of the product, delivery times and prices may change so quickly that the provider is unable to update the data published on the website on time. In such event, the provider will notify the buyer about such changes and allow him or her to cancel or change the order.

The company Zavas, d.o.o., shall not be liable for possible inaccurate information and also damage, which arose because of the use of inaccurate or incomplete information, as well as for events when information on the website could not be found and used.

Despite the provider’s effort to provide accurate photos of the product sold, all photos must be understood as symbolic. The photos do not provide a precise representation of the characteristics of the product. Copying the text and photos without the approval of the company Zavas d.o.o is forbidden.


COMPLAINTS AND DISPUTES

The provider respects the relevant consumer protection legislation. The provider shall try its best to fulfil his obligation in setting up an effective system of processing complaints and will determine a person a buyer can contact by phone or email in case problems should arise. Complaints are submitted in a written form to the company’s head office, Zavas d.o.o., Špruha 19, 1236 Trzin. The processing of the complaint is confidential.

The provider shall confirm the received complaint in five days and notify the buyer about the duration of processing the complaint and constantly inform him or her about the process.

The provider is aware that the main feature of consumer dispute is the disproportion between the economic value of the claim and the time needed and costs that may arise in resolving the dispute. This is also the main obstacle    for the consumer not to take the dispute to the court. That is why the provider shall strive to resolve any dispute in consensus. If this is not possible, the District Court in Ljubljana shall have the jurisdiction.
